Hearing Reset Due To Conflict Of Interest.


The hearing was reset from December 14th  to a future un-disclosed date due to a conflict of interest.  Mr. Huber is representing Mr. Maxwell. This was brought to the attention of Judge Randy Hill and the Caddo Valley City Prosecuting Attorney Madeline Bennington, both seemed to have no problem with the individual who by Mr. Maxwell’s spontaneous omission had ordered the act committed in the Stealing of the Central Air unit, and is also representing the accused. This seems like a travesty of justice both for the victims and the accused. How does either party get a “fair” trial? This is especially the case, when the accused is being represented and manipulated by a person who has an active interest in the out come of the trial and is not impartial.
How can Mr. Huber truly be looking out for the best interest of his client when it is his own interests at stake. That will be a determination made both by the Arkansas Bar & Arkansas Ethics Commission as to how culpable parties involved are in the handling of this case.
Never the less a new Judge is being assigned due to Stacie Huber being the Court Clerk for Judge Randy Hill interesting is Mrs. Huber was present the day of Mr. Maxwell’s hearing showing an active interest in this case.
Odd Judge Hill did not recuse himself on his OWN, knowing that Jonathan Huber was a Justice of the Peace for Clark County as well the husband of his Court Clerk, who also has an active interest in the out come of Mr. Maxwell’s fate.
How are victims rights being protected, the sole purpose of the court system, was to stop violence in the streets/vigilantly justice and to create a place for parties to air their deference in a “fair” & “impartial” system. It would seem more and more our “system”  has and is slanting to who knows whom to make decisions in a case. 
For a victim to get a “fair” and “impartial hearing”; the victims must take a standpoint to be heard and address the court themselves, or stand silent while your chance of justice is corroded by back-patting politicians and apple polishers.
